Question

My girlfriend and I have lived together for all of 2008. She has one child of her own (age 9) and we have one together (age 2).   She made 19K in 2008 and I made 55K. Can she claim Single w 2 dependents + deductions + EIC + dependent care for both children with me claiming HOH based on qualifying child, but with no deductions? A seperate question...She made 0k last year and didn't file taxes. I claimed the stimulus check for her and our qualifying child last year because I had income and she didn't, can she claim the stimulus check this year (if so, how much should she expect to recieve?)

Hello XXXXXXXXXX,

Since your girlfriend is the mother of both children, she may claim both of them as dependents and qualify for the EIC, and she may also claim deductions for dependent care for both of the children.

Since last year you received the stimulus rebate for your girlfriend and the child, she cannot now claim credit for that same rebate since they were claimed as dependents on your return. Congress is currently considering another rebate program for this year. The rebate has not yet been approved, but in all likelihood it will end up being passed. If that is the case and she files this year and claims the 2 children, then she will qualify for the new rebate this year.

You may claim HOH status, based on the one qualifying child.

I grabbed this from the turbo tax help board...are you positive that she can't claim the stimulus?

 

Using the automated system in turbo tax, it asked her how much she recieved in 2007, she said $0...and it said she was entitled to a $900 check. (To me, it seems that she should be entitled to the recovery rebate check at least for herself, because that wasn't part of what I recieved)

I did not qualify for it in 2007 I did not have enough earned income i had other income
I checked the box on the 2008 for no that asked if I got one how will I know if I am qualified this year I only have unemployment and retirement income no earned income

There is a Recovery Rebate Credit for the 2008 tax year, on your return the rebate is recalculated and if you are due the rebate or an additional amount it will be added to your refund amount.

The recovery rebate credit amount (if any) will show on Line 70 of form 1040, Line 42 on form 1040A, and Line 9 on form 1040EZ

In your original post you said "I claimed the rebate last year for her and our qualifying child".

Does that mean that last year you claimed both her and the child as your dependents?

How much was the rebate that you received last year?

I claimed myself and the 2 children (even though 1 is hers)...may get in trouble for that one. I didn't claim her as a dependant. Rebate was $1200

Your girlfriend would qualify for the Recovery Rebate if she files this year.

Actually the rules on that do not disallow this credit, even if you were claimed as a dependent last year on someone else's return.
