Question

My daughter has two children out of welock the oldest who is 3 visits her dad and grandmother on standard visititation the other one who is 2/going on three has not been allowed to visit untill recently they have no vistatation set for her she has always stayed with my husband and i when ever we could get her ,by the way she was born with only 1 leg and almost died, we also kept the oldest one when we could, now if we dont do what thier mother wants us to do for her she wont let us see them at all .also she has married and has a 4 month old but now she dosent keep them home ,she has started letting the 2 yr old go to visit her dad even though she doesnt know him and the 4 moth old stays with her husbands mom so she bascially has no children at home ,but took the 2 and 3 yr old from us and wont let us see them but the other grandparents have the all the time please help me , what can we do

In Kentucky, grandparents may petition the court for visitation. The court will award visitation if it is in the "best interests of the child". Chapter 405, Section 021 (KRS §405.021).

 

To determine what is in the best interests of the child, the court considers the following: (1) wishes of parents and child; (2) interaction and interrelationship between child and parents, siblings and other significant persons; (3) child's adjustment to home, school and community; and (4) mental and physical condition of all persons involved. KRS §405.020 et seq. and §403 et seq.
