Question

when someone is made guardian of an estate and is forced to take out a $80,000.00 bond and at the closing of probate the bond was satisfied and then thru discovery we find a missapproration of funds. Can we go back to the bonding company for loss of our funds as siblings. I understand from my previous question that we have 4 years after the closing of probate to re-enter or after discovery. Is the bond taken for probate accountable after the the discovery.

Hello,

Thank you for your question. I am happy to assist you.

Unfortunately once the bond is closed out, the bonding company is no longer liable. Your action appears to be against the person who misappropriated funds and perhaps the legal counsel that did not recognize the misappropriation earlier.

I hope that the information which I provided was helpful to you.

Best wishes for a successful outcome. If you have additional questions, please do not hesitate to submit them to me directly.
