Question

My friend was working with me yesterday and became very ill. She has cancer and was throwing up. She wanted to go to the Dr. and our supervisor wouldn't let her. She told her to go lay down for an hour
and then get right back to work. She then said "I feel so sick I need you
to call an ambulance so I can go to the hospital". Our supervisor refused
saying she wasn't really sick and then fired her. My friend went to a Dr.
at the ER after this and she was kept there for observation ans tests.

Cancer is a medical disability and she is under a doctors care. It seems
like she has a Labor Board case and can sue for her treatment at this
job and especially for being fired just because she was sick? She has a
witness to this treatment and the fact that she was fired.

I am concerned about her and especially because my aunt has cancer.
Her employers do not treat her this way. Please let me know how to advise her.

Nina Ann you are right, your friend was treated poorly as well as a violation of ADA, American with Disability Act. She should seek out an employment attorney soon and file against her employer.The attorney very well may have her file an EEOC/Human Rights Commission complaint.see www.eeoc.gov. I would think that she could find an employment attorney that would take her case on contingency fee.

 

She has been wrongfully terminated.You may want to help her with the phone calls and identification of an attorney. You also can contact the EEOC to discuss as well. I wish her well and you are a good friend.
