I apologize if I was not clear in my initial response. I will try to do better this time around. If this were her first offense, I could certainly see probation as being within the realm of possibility. However, given that this is her second offense -- and was committed while she was on probation -- I would not be as hopeful. Under California law, she faces the following in terms of the range of possible punishment for second offense petty theft: jail term or imprisonment of zero to six months to sixteen months; and/or a fine of up to $1,000; and restitution. The reason for the range -- and not being able to specify with exact certainty -- is that at this point it is impossible to know whether the prosecutor will charge her as an infraction, a misdemeanor, or a felony.
