Question

My mother got arrested 9 months ago on a petty theft case in Orange county CA and she had to pay a small fine and she was on probation for three years then 5 months after that she gets arrested for petty theft again while on probation she is 64 yrs old and is handicap. she never got anything from the courts regarding the second petty theft but continued to make payments to the store she stole from. she then got an officer arrest her at her home today and when we tried to bail her out we couldnt cuz of penal code 1275 now she is in jail for the weekend. what will her sentence be in court two petty theft within 5 months of each other, probation, and not showing up to court

I just need to know what my moms sentence will be she has a petty theft 9 months ago and within 5 months of that another petty theft she was on probation from the first offense she has a prior felony for a hit and run but that is 20yrs old and she didnt show up to court and was arrested at her house today without being able to bail her out because of penal code XXXX XXX XXXXX date is monday what will her punishment we will get her an attorney but what can he or she do and what is her sentence min to max or in your better judgement what will she probably get.

she never got anything in the mail so that is why she didnt show up to court but she did receive something regarding payments to the department store so she has been sending that out.

Please allow me to say I hope things work out as best as possible for your mother. I commend you for being concerned about her.
  2. California Penal Code § 1275, as you mentioned, is the basis for bail having been denied. You also mentioned retaining an attorney, which is absolutely the most important step to take. If unable to afford a private criminal defense attorney, your mother should request the appointment of counsel when she makes her first Court appearance.
  3. As to the consequences related to the charges, here is some information about that under California law. Petty theft is usually charged as a misdemeanor if it is a first offense, and the value of the property stolen is valued between $50 and $400. Petty theft can be punishable by a fine of up to $400 or by imprisonment in County jail for up to 6 months, or both. Petty Theft can be charged as a felony on your second offense under California Penal Code § 666. A second conviction of Petty Theft can carry a maximum sentence of 16 months in state prison. Not all courts will charge a second Petty Theft as a felony. In fact, many courts do charge a second Petty Theft as a misdemeanor, depending on the value of the property taken and the time that has lapsed since the prior Petty Theft.
  4. It is imperative that your mother assert her rights to remain silent, to counsel, and to avoid self-incrimination -- not make any statements to the police.

Thank you for those answers but i need to know what her sentence will be since she has a previous petty theft and now another one and the time lapse is only five months from each other, and that she is on probation for her prior petty theft what will the outcome to her sentence be? jail time? fines? probations? please let me know thank you

I apologize if I was not clear in my initial response. I will try to do better this time around. If this were her first offense, I could certainly see probation as being within the realm of possibility. However, given that this is her second offense -- and was committed while she was on probation -- I would not be as hopeful. Under California law, she faces the following in terms of the range of possible punishment for second offense petty theft: jail term or imprisonment of zero to six months to sixteen months; and/or a fine of up to $1,000; and restitution. The reason for the range -- and not being able to specify with exact certainty -- is that at this point it is impossible to know whether the prosecutor will charge her as an infraction, a misdemeanor, or a felony.
