Question

I was told if I write to the IRS about my problem with adjusting my tax statement from 2006--They may let me write it off and not pay. Problem--In 2006 I had my children and when it was time to file for taxes, my ex filed the children too. The kids lived with me for the whole year--we went to court and I was told that he would be able to claim the kids for 2006, then I would be able to claim them in 2007. Anyway I don't know how to amend my taxes and because I was told I might be able to have the IRS write off my bill and not have to pay. It can't hurt to try. I was told they would look at my past filings and make a judgement from there. Is that possible?

Hello and thanks you for using Just Answer. You must file an amended tax return for 2006 to correct errors on your 2006 tax return. The form to use is Form 1040x (<a href="http://www.irs.gov/pub/irs-pdf/f1040x.pdf" target="_blank">www.irs.gov/pub/irs-pdf/f1040x.pdf)</a> . The IRS will not make changes unless you file the amended tax return.

<br />The Federal 1.152-4 states, "A state court order or decree does not operate to allocate the federal exemption between parents." The state court order can say who gets the exemptions, it is worthless for tax purposes. The noncustodial parent can claim the child if the custodial parent signs a written declaration unconditionally releasing the exemption. This declaration can be on the Form 8332 (<a href="http://www.irs.gov/pub/irs-pdf/f8332.pdf" target="_blank">www.irs.gov/pub/irs-pdf/f8332.pdf)</a> or any other form that conforms to the substance of the Form 8332. The noncustodial parent attaches the original form to the original return.

I am not trying to cause any problems with my ex at this time. We have enough issues to deal with at this time.

What I want to know if I can write the IRS and have them eliminate the debt I would owe when I amend the 2006 tax return. Does that ever happen? Is there a possibility? It may not seem like a lot of money to some--but, to me it can hurt. Thanks.

Answer

You can claim the earned income tax credit and head of household filing statues without claim the tax exemptions for your children. You should file an amended tax return and only claim the earned income tax credit and head of household filing statues in 2006. You cannot eliminate your tax debt without filing an amended tax return.
