Question

I have an active warrant for my child support. I want to see my kids but my ex is a little on the crazy side. I have been out of work for months and i have applied to over 60 plus places. I am a carpenter by trade and I am not finding any carpenter work. I have applied at McDonald's etc. I owe 5,500 in CS. We were living in the same dwelling in NJ when she filed for child support. She hid all of the paperwork from me. She picked up from NJ, got married, took my kids and moved back to MD where we are originally from. I am fine with the fact she got married and I hate that I do not see my kids, however, I am very upset that I owe all this back child support Now I have a bench warrant for my arrest. I want to do the right thing. I have a job interview today and I am hoping that I get it. The minute I get this job, I want my kids to be taken care of and I want the money to get out of my check. Am I able to take a job in another state if I have a warrant. My kids live n the stateof the job

Answer

Unfortunately, you really need to go and get that warrant taken care of. You can take a job in another state even with the warrant, but you run the risk of the employer refusing to hire you if they discover it. You should go to legal aid or hire a private attorney to represent you and get them to assist you in getting the warrant recalled and getting some time to make up the money you owe based upon your dire financial circumstances and unemployment. You would need to show proof to the court of your efforts to find work and simply ask that the support amounts be changed based upon your unemployment causing a significant change in financial circumstances and to also grant you some additional time to pay the back payments.
