Question

Should I file 990 tax without all the information: I am the bookkeeper for a veterians group. Have not filed this years tax return asdue, I filed for an extention til June as we also file 990T.   Director retired Oct.2007, the new director could'nt find Invest. funds they should have. The X-Director was no help. a lot of money. Still not accounted for. The X-Director was the only one who had a name on the accounts so no acct info could be obtained. In the process of a book audit by a frensic auditor, I do not believe they will find anything. The X-director would give me what the balance in investment funds and interest earned at the end of the year for taxes. Now heres my problem----the Director wants me to file the 990 and 990T without this info, she says she will attach a letter explaining the situation. To file I have to sign these returns and something I don't want to do this way. If you were in my shoes what would you do or tell them. I have no idea how to handle. Help

Naturally, it is never a good idea to file a return when you do not have all of the information you yet need. However, if you do not file a return by the due date or extended filing date, then in addition to any taxes that you may owe, you would also be hit with a late filing penalty.



If you go ahead and file now, you should just be prepared to file an amended return as soon as you have all the required information available. If the amended return results in more tax being due, you will also have to pay penalties and interest for late payment, but would at least avoid the late filing penalty.



Attaching a letter to your return to explain the circmstances would be appropriate, although it will not relieve you of your obligations to eventually file the corrected return. In the event that the IRS questions your situation, be sure to keep detailed records of the audit you are having done and anything else you have attempted to resolve this matter, so that you can show you have demonstrated a good faith effort to resolve this as quickly as possible.



If I were you, I would ask your Director to sign the returns once they are prepared, and he should also be the one writing the statement of explanation to accompany the return.
