Question

I have been dismissed fro a construction Supervisory position, Labor Standard cannot help and I have a contract that my employer will not honor. Do I have a leg to stand on as far as honoring my contract that stipulated that I will get 6 weeks notice for dismissal, will get paid in $ or in time off with pay for overtime paid (over 40 hrs/week) will get three weeks holidays and get full benefits for my family and I (for which I repeatedly requested being implemented) Do I have to go in small claims ? I have over 350 hours of overtime to be paid plus the six weeks notice plus three weeks holidays or 6% vacation according to my contract. They offer 3 weeks pay and I walk away. What should I do?

Answer

If the contract was not honored you should press the company to honor it by letter, preferably by counsel.

 

If that fails, you would indeed need to sue for breach of contract in small claims court.
