Question

Hello, I worked for a company in New York for 14 years and have never been promoted. I have had excellent reviews every year by over 7 different supervisors. Every time I have asked about ways to advance in the company, etc I've been told we will look into it or get back to you. I am an African American male, college educated, and no matter what I do I was not given an equal opportunity for advancement. People who were less qualified with less education were given opportunities (which I knew I could do) constantly. Finally being frustrated I put my resignation in the company gave them 3 weeks and right before my last week that company told me they would like to keep me for 10 more years and would like to discuss future career opportunties. When i asked what these were they were very vague. I saw this as the same old excuses from the past. I wanted to know if this would be seen as a case of workplace discrimination and should i file a complaint with the EEOC or is this unfairness

I am currently in Las Vegas, I left my job on 10/1/2008. I trying to understand why having an employee who gets excellent reviews, has the education, is basically the ideal employee but has never been given a chance even when asked several times. Is this just unfairness or could the question be asked why after 14 years hasn't this employeee been offered any training at all or advancement. I have copies of all of my reviews.

Absolutely, this could be a case of employment discrimination under Title VII and your state anti-discrimination laws. Although you should have contacted the EEOC before quitting, you should still do that now asap. File a complaint with them and ask for a referral to an employment law attorney in your area.

 

The attorney should provide you with a free consultation and take your case on a contingency fee basis so you pay nothing unless the firm prevails on your behalf. Lawyers.com is also a good resource for locating an attorney to represent you.

TK Gehres, thank you so much for your reply. I didn't file a complain with the EEOC while I was there because I just felt that I would just move on to somewhere else and just forget this miserable experience and find a job with a company that will hopefully offer me advancement opportunitities. When I moved out here to Vegas my family were the ones who felt that I should look into this further as they believe I was discriminated against. I personally feel that I should have spoken to the the VP of Labor Relations at the company but I never did only I voice my concerns with my supervisor and Vice President of the department I worked in.

Well, you spoke with the individuals you needed to in order to support your claim. The VP of Labor Relations likely would have done nothing to assist you if your immediate bosses were unwilling to.

 

The EEOC has strict time limitations, so don't delay contacting them.
