Question

The timber frame is not "attached" to the land in his opinion! It has been screw and bolt mounted to the owner's foundation. In no way is it physically integral to the property--no holes, etc. ?????????????

Thanks so much for giving me the opportunity to assist you with your question through JustAsk. If an addition to real property is attached to the property so that it become a part of the real property then it becomes an attachment to the real property. Each case is look at on it own specific facts. An example would be if one added a deck to the outside of the property then this could be considered a fixture added to the property.   I hope this helps with your question.
