Question

I received an employment offer, accepted the offer and began employment on January 5, 2009. On January 6, 2009, I was told I had to leave the premises because the HR department had failed to get approval to hire me from their corporate HR department and the local Dept of Labor office. Now I've found out that the corporate HR department wants to rescind my employment offer. What is my recourse if any?

Unless your offer has a definite and certain future termination date, you have no recourse.Under the "at-will" employment doctrine, an employer can terminate an employee at any time and for any reason -- good, bad or for no reason at all.

 

The only exceptions, other than based on an employment contract with a definite and certain future termination date, are those based upon unlawful discrimination and public policy rationales, such as race, color, nationality, religion, sex, age, disability, Family Medical Act leave, workers compensation claims, jury duty and witness subpoenas.
