Regarding debt. My wife and I found ourselves in serious debt after I lost my job in 2007 due to extreme medical bills for my son. We used credit cards. I also have a student loan for my started but not finished MBA. Currently these loans are way over due. The agencies are all over us. They want to deal as of now I'm on unemployment and my works at a hospital and she doesn't even make enough to make our mortgage. Additionally our mtg is one that has made the news. When we took the loan it didn't concern me about the interest only; I was very well employed. We were going to refi after about 6 months. That's when the medical bills started.

So, I've tried to speak with mortgae company...no deal yet. we've been sued so far by three creditors ending up with judgments against us. Other creditors just want a payment plan of some kind. Right now with unemployment and food stamps what can I do? File bankruptcy can we keep our house? We've lived here for 21 years

You can consider filing a Chapter 7 bankruptcy. It may give you the financial relief that you need and still allow you to keep the house.


As an individual, there are two types of bankruptcy available. A Chapter 7 and a Chapter 13.


There are distinct differences in between a Chapter 7 and a Chapter 13 bankruptcy.


A Chapter 7 bankruptcy could discharge (erase) all of your credit card debt. It would be an opportunity for a fresh financial start.


A Chapter 13 bankruptcy could reinstate a mortage that is in default. However, it may require that you repay some of your unsecured credit card debt. It does not appear that a Chapter 13 would assist you.


Legal Aid can assist you. I suggest that you give them a try.
