Hi,
You just replied to my e/mail regarding a foot injury at work that I wasn't sure if it was becoming a hostile work environment. Like I noted, I suffer from depression and anxiety (which my boss and owners know) and feel very uncomfortable going into that work environment - have had panic attacks the last few days to keep me from work. Some of the definitions I read regarding hostile work environment stateUnlawful harassment is a form of discrimination that violates Title VII of the Civil Rights Act of 1964 and other federal authority.

Unwelcome verbal or physical conduct based on race, color, religion, sex (whether or not of a sexual nature and including same-gender harassment and gender identity harassment), national origin, age (40 and over), disability (mental or physical), sexual orientation, or retaliation (sometimes collectively referred to as "legally protected characteristics") constitutes harassment when:

The conduct is sufficiently severe or pervasive to create a hostile work environment; or

A supervisor's harassing conduct results in a tangible change in an employee's employment status or benefits (for example, demotion, termination, failure to promote, etc.).

Mental disabiliites are NOT generally actionable unless you prove it is more than temporary and permanently impairs a major life function. Under the Americans with Disabilities Act you cannot just say you have a disability, you have to notify the employer and then you have to ask for a reasonable accommodation based upon that disability or your employer has to treat you as though you have a disability. Additionally, as long as the employer is not terminating you based upon your disability or creating the environment based on your disability or perceived disability the ADA does not get implicated, but you still should file your claim based upon retaliation under the FMLA and workers compensation with the state commission on human/civil rights (regardless you cannot sue for hostile environment until they give you the right to sue letter anyhow).
