Question

I am in a law suit with the State of Colorado. I have submitted an offer to them regarding settlement of this case. Can I resend the offer because I feel I have a better case. If they accept the offer can I still reject mine.

I have an attorney that is only doing one more thing, which is the phone call with the judge and opposing counsel for pre heearing because I cannot afford his services.

Accepted Answer

You should rescind the offer before it is accepted. Thus, you should send a letter via fax to the other side's attorney stating that the amount of the offer is erroneous/scrivener's error and to disregard the amount stated.

 

IF they accept, you can still try to rescind the offer, but it will be more complicated and would probably take a court order to back out.
