Question

I was given the option of resigning or being terminated. My supervisor stated that she no longer trusted my judgement because she had been told that I was having an affair and when she looked at the company phone records I had many calls to this man's phone. There was no policy on phone use and one of the business phones was often with the supervisor's daughter (on personal trips). The supervisor also stated that I had shown more poor judgement by buying a motorcycle when I was so accident prone. She allowed me to work a 3 week notice with all of the same responsibilities and gave me a 6 week severance package. She has written me many glowing letters of reference and many were for positions with similar responsibilites. I have been unable to find a job and the Dept. of Labor granted me unemployment insurance and now the employer has filed the appeal. What should I expect and how do my chances sound of keeping me EUI?

Unemployment hearing officers generally lien towards the employee. If there was no policy on phone use that you violated, then it probably will go your way, because you can't violate a company policy that you don't know exists -- therefore, your termination was due to "no fault of your own."
