Question

I have not received wages earned 4 months ago, my employer says they don't have the money to pay me. They have a contractors license with a surety bond and I am in the process of filing a claim with the ccb as advised by my state's labor board. They were unsuccessful in getting any response to the demand letters they sent to my employer and state there's not much chance collecting anything unless I file a complaint with the ccb and collect from the bond. It took the labor board more than 3 months to come to this conclusion. Does this mean it will be another 3 months or more before I get paid? This has financially devastated my family. I cannot even qualify for unemployment because the wages are not showing as earned since I was never paid. I have been looking for work daily to no avail. Is there anyway I can speed the process up? Also, many violations equal many penalty fees, but can they be collected on the bond? State is Oregon. Please help me and fast!!!

Hello, you have done the right thing so far. The process takes a while. However here are a few more options, contact the US Labor Dept to file a complaint, seek to file in Small Claim court for all wages earned but not yet paid. You can file yourself without an attorney. Contact your local courts.Third, retain an attorney to write a letter of Intent To Sue for earned wages not yet paid. You may need to try several options to help collect your wages. You may also consider contacting the IRS if the employer has not paid taxes on these funds. Hope this helps
