can i sue the person next door for terrorizing my wife and i for the last few years he has attack me 2 times one of the times throeing a 5 to 6 foot steel rod at me. he cant under stand the property line and tosses are stepping stones tossing them about . he has caused property damage more than once , and has a track record of this kind of conduct . we had talked to his old next door neighbors and they told us a similar story . we even paid a few grand to have the property surveyed . we know were the line is . this is just a little bit of it .it goes on and on and on . we lived here ten years never having any issues like this till he moved her and started his rain of terror depriving us of enjoying are property, and adding to health issues .my wife having m.s. stress exasperates her condition and after two or three of his encoders with her she ended up in the hospital after each of them

we have made a few police reports. we went in front of the home owners association to have them help with some of his parking issues , and they helped with that we've tried ignoring him we had the property surveyed this man needs conflict in his life he even verbally assaulted my 83 year old father

Answer

The primary recourse for such harassment is to file a police report and seek a restraining order.

 

A lawyer can also send a letter to avoid all further contact.

the police don't even seam to want to get to involved with this . we have started paper work for a restraining order . but are considered about his unpredictables behavior, and with are witnessing his blatant disregards for any thing dealing with authority hell just blow it off then we to what every time we have a confrontation call the police or Evey time he trows are property around and when we notice it call the police. when he physically attacked me and i said what the f**ks your prob . i didn't hit him back i felt i really Delt with it in a very non advisee and fairly responsible manner the police told me . if i file charges and have him taken to jail they would have to take me to jail to because the statement "what the f**ks your prob " was considered an assault to...... looking back i should of told the take me to jail for it , but were I'm going with this is the cops don't feel this is a problem they should deal with . and i agree its childish stupid and one of these days it going to end up with someone getting killed here. and most likely it will be my wife and me

If the police are not taking you seriously, as to speak to a more senior officer or captain, contact the prosecutor's office and consider retaining local counsel to press the matter with both.
