Question

I believe I was falsely arrested about a year and a half ago. Someone I knew had a boyfriend that was a cop and somehow they got me arrested for a "text message harassment" I never harassed this woman or even threatened her, I still have the messages saved in my phone. I was on probation for a DUI and the girl knew it and did that on purpose. So the cops came into my work and arrested me in front of everyone and I had to sit in jail for a week. I was wondering if I can sue the police station for false arrest?

Answer

You can sue but the real question is whether or not you can win. You should contact an attorney that handles cases under Section 1983 of the federal Civil Rights Act of 1871, 42 U.S.C. § 1983 to see if they are willing to take this on.
