Question

My daughter won a lawsuit. When the check was presented by the attorney representing her and myself, my daughter (over21) signed the check and I deposited it into the bank. I then transferrd it to a trust company, and would withdraw money whenever she wanted. The funds were in my name. She has gone through the money, and is now suing me for three times the amount of the original amount won, and her lawyer has said that if I do not answer them within 14 days and provide all of the documentation he will proceed to sign defauly judgement without further notice. There is no more money, I did not use hers, and I cannot afford to hire an attorney to represent me. My daughter resides in Canada, I reside in the U.S. ( I am a legal resident here ). I cannot prove all of the money I gave to her. What will happen to me? Will I loose me home? (it has a mortgage and home equity loan), Will my wages get garnished?

I have responded to the attorney stating that I did not misuse her money, but I cannot prove cash that I handed to her. There is much of it that can be traced through paperwork, but as well a lot of it can't. I deposited this money into the bank, they in turn transferred it to the trust company. At the same time, my daughter was involved in drugs (severely) and I truly believe that she does not remember everything, that she did with the money. I am really scared that i will loose my home,& my life.

You must legally respond to the lawsuit filed against you. If you do not respond, a default can be entered against you.



To do this you should file an answer with the court and send a copy to the attorney for your daughter. An answer should have the same case caption as the complaint filed against you. It should be titled Answer. In the answer, deny each of the allegations in each paragraph of the complaint that your disagree with.
