My room mate and I are bracken our lease, and when sing the lease we told him that we wanted to pay 3 mouths in advance, cause we are paying it out of our student loans. now he dont want to give us Jan. rent back can he do that?

Assuming that you paid December's rent......you have breached the lease. He must try to re-rent it and cannot collect double rent. However, he is within his right to keep January's rent. With the holidays, it will be improbable that he will rent the place for 1/1/09.
