Question

I signed a rental lease agreement on November 17, 2008 for my move-in date to be December 1st, 2008. I contacted the rental agent via emial on November 20th, 2008 and asked her if I changed my move-in date to the 5th of December, would my 1st month's rent be prorated. Her response was that I would need to pay full months rent to move-in on the 5th and my January rent will be prorated to deduct the five days I was not in the property. I contacted the agent via email on December 11, 2008 to ask her what my rent would be for January, and she told me the full amount. I advised her of what she told me Nov, 20, 2008. She has the property manager call me and told me that I was told the wrong thing and I would have to pay the full months rent. So my question is, if their agent gave false information, shouldn't they go by what I was told or do I take the fault for being told the wrong thing and pay a full month's rent?

Answer

I am afraid you would need to pay the full month of rent since you have nothing in writing. If you can written confirmation of the pro rated decision or her admission, then it would be different.   Practically and legally, not worthy to litigate over without something in writing.
