Question
My grandfather has Alzheimer's and my mother was taking care of him until she became ill. After her operation she attempted to resume care until she became ill again. She died roughly 8 months ago. During the burial and grieving process, I mentioned to my uncle, his brother, that I would begin to care for my grandfather. He said he would take care of it. I would call my grandfather every Sunday to check his status. A few days after Thanksgiving I was notified that my grandfather was found wandering and was put in the hospital. I later found out it was the psychiatric ward. I attempted to contact my uncle and he has not returned and call and is avoiding me. I cannot get any hospital status because of HIPPA they say. My uncle has a manufactured power-of-attorney and will not add me to any list granting me rights to even see him. What do I do? Can I challenge what he has started? I just want to see my grandfather. I really need help.

Thank you for contacting Just Answer. I look forward to assisting you.
While we write back and forth, please keep in mind that I do not know what you already know or don't know, or with what you need help, unless you tell me.
There can also be a delay of an hour or more in between my answers because I may be researching the answer to your question, helping other customers, or taking a break. If we are writing late at night, I may have to go to sleep and resume helping you the following morning.

For more information about your matter, you should consult with an attorney of your choice in a traditional face-to-face or telephonic meeting.
The hospital cannot give you information about your grandfather; they invoke the HIPPA laws quite correctly.
Have you tried sending a certified return-receipt letter to your uncle stating that you wish to see your grandfather and asking him why he is refusing to allow it? This provides you with proof of delivery and puts him on notice that you intend to pursue this matter.
If you get no or an unsatisfactory response from your certified return-receipt letter, the time will have come to hire an attorney in Pennsylvania to pursue your visiting privileges and see if you can get on to the list of people to whom the hospital may release information regarding your grandfather.
Good luck; this is a hard time for you, I'm sure, and it's not made any easier by the privacy laws that the hospital is required to follow.
