Question

HELLO, I HAVE A CIVIL CASE THAT IS SET FOR TRIAL ON DEC 15TH ON MONDAY. THE JUDGE GAVE ME AN EXTENSION TO FIND A LAWYER FOR THE TRIAL, BECAUSE I HAD TO FIRE MY FORMER ONE. I HAVE AN ARBITRATION HEARING WITH THEM BUT IT WILL NOT BE HEARD UNTILSOMETIME NEXT YEAR. THE STATE BAR COULD NOT GIVE ME A DATE. SO THE PROBLEM IS NO LAWYER WILL TAKE MY CASE UNTIL AFTER MY ARBITRATION HEARING BECAUSE THE OLD ATTORNEY PUT A LIEN ON MY CASE, SO IF A NEW LAWYER WERE TO TAKE THE CASE, HE WOULDN'T GET PAID UNTIL THE ARBITRATION AND LIEN IS SETTLED. SO I NEED TO ASK THE JUDGE FOR AN EXTENSION UNTIL AFTER MY ARBITRATION. HOW DO I DO THAT BEFORE MONDAY THE 15TH?   IT IS IN LOS ANGELES SUPERIOR COURT CA. STANLEY MOSK COURTHOUSE. THIS MONDAY. IT IS A LEMON LAW CASE
ALSO IN ORANGE COUNTY COURTHOUSE FOR FAMILY LAW MY EX HUSBAND FILED AN EXPARTE LAST WEEK BECAUSE HE WANTED MORE VISITATION AND THE JUDGE SET THE DATE FOR MONDAY DEC 15TH ALSO! ON THE SAME DAY AS MY TRIAL! SO I HAD THAT HAPPEN TOO!

Answer

Suggested you send a letter, certified mail explaining the difficulty and outlining your efforts to obtain counsel. Consider seeing if you can get pro bono counsel through the local bar association or referal from the court. Try calling the judge's chambers and advising of the status in advance.   suggested not waiting until the trial date to make the application.

WHAT IF THEY TELL ME I HAVE TO SHOW UP, WHAT DO I DO ABOUT THE OTHER CASE?

Accepted Answer

You should cc all parties and judges/arbitrators involved in the matter.   If told to show up, you should make the application in court and prepare to proceed without counsel should the court refuse you a further extension. Continue to try to retain counsel through www.martindale.com, inquiry with bar association and other means and document your efforts to the court.

SHOULD I ASK THE FAMILY LAW FOR AN EXTENSION? JUST IN CASE THE LA JUDGE WANTS ME THERE?

Answer

As a rule of thumb since you dont have counsel it would be wise to move things but prepare for a rejection if the matters have been delayed or the judge is simply not inclined. it is within the judge's discretion.

I THINK YOU DON'T UNDERSTAND, I HAVE 2 CASES, BOTH ON THE 15TH. ONE IS TRIAL IN LA. THE OTHER IS FAMILY IN OC. I DO NOT HAVE COUNSEL FOR EITHER ONE. THE LA TRIAL HAS BEEN SCHEDULED FOR 6 MO.
THE OC FAMILY WAS AN EXPARTE LAST WEEK THAT GOT SCHEDULED ON THE 15TH BECAUSE I WAS NOT AT THE EXPARTE OTHERWISE I WOULD HAVE TOLD THE JUDGE THAT I ALREADY HAVE A TRIAL IN LA ON THE 15TH

Answer

You should seek to adjourn both in advance by calling the judge's clerk and advising of your lack of counsel, the lien situation and the scheduling conflict.
