Question

I live in North Carolina and I have a question regarding larceny. In a very stressful situation I ended up removing items from the job that I was working at on a military base. The total exceeded the amount and to my best knowledge would be considered a felony. They asked for the items back and I did and I was told that if charges were to be filled I would be notified. They had my cell phone number, address, and new I was going to college on a scholarship. I was 17 at the time and as I said, I was told I would be notified before I went to college. It has been a little over four months now and I have heard nothing. The only thing recieved was a letter from my job saying that I was not rehireable. I also did not recieve my last pay check. During the search of my vechicle they took personal items because it was a 'suspect' larceny case. I could care less about the items or the check but I am wondering should I be worried? Again its been over 4 months without any word.

It is not at all unusual. This is especially true because the offense took place on a military base, which is under the jurisdiction of the federal court. The good news for you is that you were a juvenile at the time, and there is no provision inthe federal law for prosecuting juveniles. This should not appear on your record, and you are probably safe from prosecution.

I kind of understand that. Is there a reason why I haven't recieved my last paycheck or the items. They did mention they just wanted their items back, but still this kind of has me worried because I am in college and doing great. Involved in serval activities such as an RA position, community service, and things in that nature. The more time accumulated, does that help me at all? I would at least think I would of gotten a phone call or something saying they were going to press charges. I spoke to the best defense attorney in my area and they said I should have been contacted within a few days after on a decision. I am asking this too, because will be going to England this summer for study abroad and I'm not sure if I should be panicing or not. Also a friend of mine asked her mom, who works at the paralegal office on base about it and she said, That I should of heard something by now if they were going to do something. That the base doesn't play around when they want to press charges and that because I was turning 18 soon, going to college, and the fact I didn't lie and gave the items back unused I was fine. Is this somthing you thing is true? I've also kept a log on all of my community service hours just in case, is something worth doing in the even I have to go to court?

If you came to see me about this, I would tell you I was about 98% sure all would be well in your situation.

 

As for your final paycheck, they have to give it to you unless you agree otherwise. I guess it will be up to you to decide if you want to go back to them and ask for it. Seems like it would be courting trouble.

 

With respect to traveling outside the country, the law says that juvenile cases are not reportable in general, and they do not appear on your record. Therefore this should not interfere with your trip to England.

I thought the same thing. They can keep the items and a check if it were to get me "off" the hook per say. I'm in school to be a defense attorney and just paniced when I recieved the bill. I know bad choice. In the event it does come to surface thats when I'll bring up the check and the items. But thank you so much for help, I wasn't too worried about it but then just sitting here I began to be. Once again thank you very much, you've been very helpful in this issue and I will be sure to accept your response.
