I am interested in using the civil courts to create protections for OTR truck drivers. OTR drivers are currently exempted from all state and federal wage laws. In a tight labor market supply and demand keep employers in check, however the recent changes in the economy have created over the top abuses.
These abuses include but are not limited to;
Forcing drivers (employees not contractors) to do hours of uncompensated work each day
Requiring drivers (employees not contractors) to absorb unreimbursed expenses
Paying drivers in “miles” which are in reality continuously variable compensation units not units of measurement denoting 5,280ft.
