Question

I am a licensed foster parent in Cuyahoga County which is located in Cleveland, Ohio. My friend has a nine year old son that she is having difficulty caring for now because she has MS. She wants him to live with me and give me quardianship of him. I am willing to do this. Where do we start.

Hello,
You have to go back to the court and ask for a modification of the guardianship to have you named as the guardian of the child. Since you already a licensed foster parent, that may make the process quicker. But, the court will have to terminate the first guardianship and then open a new case with you as the new guardian of this child because of the other guardian's MS issue.

I should have stated that my friend with MS is the mother of the child. She adopted him when he was about 3 years old. There have been no other guardians since the adoption. Our immediate concern is to get him enrolled in school in my city.

Hello and thank you for your payment and follow-up question.
You would be able to go to the court and ask for a temporary guardianship of the child. The mother would sign her consent and the biological dad would have to be given notice. The courts usually have free clinics to help individuals fill out these documents. I would go to the court to see if this is available, if not, then I would hire a paralegal to help with the paperwork.
