Question

I wrecked my 2007 Dodge 4x4 quad cab.I purchased full coverage insurance. The Insurance says it was a total loss.
I purchased the truck 15 mos. ago for $28k. The insurance company is offering me $16k , another $1000 for tax, title and liscence now . The truck has avg. mileage 36,000, and was in excellent condition.
NADA book is $19,780
Kelley book is $21,000
Auto-trader avg is $19 400
What can I do/say to get the top value $20,000 + from the insurance company?

Optional Information

hubbell, Michigan

Already Tried:
1)sent copies of NADA and Kelley book values

2)called and received quotes from 5 local dealers and two from another state. The dealers say, if they had one like mine it would be $20,000+, one dealer is a friend and says wholesale price is 17-18K for the last two months.

3) contacted my agent to inform him I am unhappy about the service his company is giving me, I pay their price semi-annually( I also have three other vehicles and my home owner's policy with them), however, when I try to get what I am asking for I am getting a low ball price

Hi, and welcome to Just Answer. Thank you for entrusting me with your legal issue. I will do my best to assist you. During the course of our interaction , I may need some additional information. Also, please keep in mind that while I assist you, I don't know what you already know about the issue unless you tell me.

They are underpaying you in light of the book values. The dealer info in your 2) is not relevant however. Your 3) may be true but also does not affect the case.

I believe this is an unfair settlement practice. I would write a letter of complaint to the state Insurance Department. Before you send it, send a copy to your company and tell them if they do not pay 20K in 7 days you will maik the complaint to the state. Send the letter certified mail rrr and regular mail.

THIS IS FOR RVLAW

Thank you for the suggestion, I am typing the letter to the State Insurance Regulator this evening and will send them out registered mail to the insurance company and my agent in the morning. I will wait for a reply from them prior to sending it to the state.

If you have any other Ideas I would enjoy hearing from you again.

Thanks for your help RVLAW.

Very much appreciated,
