Question

I want to sued Sedgwick CMS for taking over the workers compensation and liablity without properly checking to see if Consolidated Freightways was properly self-insured. I NEED case law that would indicate that Sedgwick had a legal obligation to make sure Consolidated Freightways was Self-insured before they could have acted as the 3rd party administrator. I would like to sue Sedgwick for Fraud and deceit for acting as an Insurer, even know they only claim to be a 3rd party administrator for Consolidated Freightways Corporation of Delaware who had their self-insuance revoke in 1996 and never reinstated. Sedgwick acted as the 3rd party administrator for 12 months from April 1, 2001 to Sept. 3, 2002. My accident was on August 4, 2002, and I received stop payment on my checks on August 30, 2002. I need case Law to hold Sedgwick accountable. Note: No other insurer was enforce only Sedgwick.
