Question

My previous employer has made a false staement about me to a new prospective Employer and now I am out of the running. My previous employer stated I sued him for severance pay. We never went to court. I used a labor lawyer to negotiate a settlement. Do I have recourse against him?

No, the statement is not entirely false. Many lay people, including employers, perceive that getting a lawyer involved is indeed litigation and the statement is not completely false, you did make a claim against the employer for severance and hire an attorney to pursue the claim, even though an actual suit was not filed because settlement was negotiated prior to the actual suit being filed. This is something the court would dismiss as not being a false statement, just that the employer misunderstood or used wrong terminology.
