Question

I just returned to my job on 12/01 as an 3rd year apprentice electrician following three months of therapy and rehabilitation for a back injury suffered at work. I have worked for my employer, a medium sized commercial and residential contractor, for three years. I was covered under Connecticut Workers Compensation insurance during my absence. I believe I am going to be laid off at the end of this week, ostensibly because of seasonal slowdown, but I believe my employer intends to "get rid of me" because of the perceived risk of my injury re-occurring and becoming chronic. Would I have any cause for a legal proceeding if I'm laid off after only a week back on the job? There is an ex-manager(who recently left) the company that says he has direct knowledge of the company's plans to remove me for this reason (risk of further injury liability).

Answer: If you can show a connection between the injury/leave and the lay-off, and other people aren't being laid off, too, you could file a complaint with Worker's Comp. They'll do an investigation and try to negotiate a settlement at the same time.

 

You may also have cause to file a disability discrimination complaint and/or lawsuit, because perceived disability is covered by law similarly to actual disability.
