Question

My husband and I received a summons in the mail today from a credit card company. We have been trying to pay on this bill but due to unemployment and layoffs of job, we failed behind on the payments. What do we do next with this summons?

We have contacted Wells Fargo and we were paying what we could on the credit card and we just fail behind on payments. We have other obligations that are necessity right now that has become before the payments on this card. We understand that it is our debt but we cannot afford to lose our home or go without electricity trying to make payments on this card right now.

Sorry to hear what you are going through. The next thing to do is file your Answer to the complaint. An answer is where you state your side of the story and whether you agree or disagree with the allegations cited against you in the summons and assert any applicable defenses. You generally have some limited period of time to submit your answer (it should be stated in your GA summons) so you need to make sure that is prepared, filed and served upon the other party. If you do not file an answer the court may issue a judgment without taking your side into consideration. So it is important to make sure you file an answer as soon as possible.

You can ask the court clerk in your county if they have an answer form or check with your law library for the practice guides on how to write one.

This is so embarrassing and I feel that I am going to break down and cry. Me and my husband both work and try to maintain our household now that we both have stable jobs. It seems that we can't win for losing. Is a summons adevertised in a local paper?

Don't feel embarrassed it is not as if you are intentionally avoiding responsibility.

A summons is only advertised in the newspaper if you are unable to be located and served (called notice by publication). Since service has been successful through the mail, your summons should not appear in the local paper.
