Question

Florida - Child After Care, run by local government agency with 100% funding from The Children's Trust, which is funded 100% by the taxpayer. Am I entitled to copies of incident/discipline reports, on behalf of my children, that I have had to sign? I know FERPA applies to their public school but does it also apply to child (after-care) programs?

Optional Information

Hialeah, Florida

Already Tried:
I have verbally requested the records 3 times with "we cannot do that." I am in the process of writing a letter and would like to insert the actual legal clause as to why they have to furnish the records.

Thank you.

Thanks for your question. Maybe if they receive funds from the Department of Education. You should make inquiry about requesting such records. They have to have such a process in place here. I am giving you a FERPA site, it just depends on funding sources. But regardless you shoul have access here to request such records...

Request in writing and request a written response here with authority if you are denied in '
this matter. Always do ti in writing to force the issue here. It is tough to know if it applies here without knowing more about their infrastructure and funding but it sure might. They are probably a quasi public agency with community funds from different places..
