Question

I quit a job about a year ago due to harassment. After viewing a blood borne pathogen video at my current job I felt the need to report my past job to the Indiana State Board of Health, due to the work practices that was taking place. They will be investigating, because it is a very serious health matter that became the center of harassment. How do I go about filing a report with the Labor Board?

I worked for an assisted living complex in the housekeeping department. My job title was housekeeper 1, but I was called a floor tech. Being such, I was the only person able to operate a carpet extractor.

The weekend cleaning system: A resident would have an accidenal bowl movement on thie carpet. The housekeeper would clean the bulk and leave the stain for me to clean on Monday. The Board of Health will be invesigating this claim.

Thank you for your question and I look forward to assisting you. Please keep in mind that I can only respond to your post and the information contained in it, as I do not know what you know unless you describe it fully. Also, due to site tech reasons, oftentimes I am initially only able to see the first part of your post, so I apologize in advance if it means more interactions between us. Also, oftentimes there are future facts that are as yet undetermined in your matter, that can and must leave some areas of information provided by me broad in nature. However, don't hesitate to ask for clarification if needed! At times, there can also be a delay of an hour or more in between my answers because I may be helping other customers or taking a break. That being said...

 

With regard to the Indiana Dept. of Labor's complaint system as pertains to the Occupational Safety and Health Administration (IOSHA), to make a complaint, you will need the following information:

  • Name, Address, and Telephone Number of Employer (Company)
  • Your relationship to the Employer (ie, employee, ex-employee, union representative, or relative of employee)
  • Description of the possible violation(s), including
    • exact location in company where it/they occur(s) (area of room, bay number, machine number, etc)
    • number of employees exposed
  • Type of Business (what the business does at that location)
  • Name of Management Official that you have talked to about your concern

Put your complaint in writing. Be sure to include your name, address, and telephone number, so they may contact you if they have any questions. This information is kept confidential from your employer. You may make your complaint anonymously if you are concerned about this.

 

Sign your written complaint and either fax it to the Complaint Duty Officer at XXX-XXX-XXXX, or mail it to:

Indianapolis, IN 46204

 

You may also call and speak with the Complaint Duty Officer, at XXX-XXX-XXXX.

 

Now, if you want to assert that you were retaliated against, ie. harrassed, you first may want to go and file a charge with http://www.eeoc.gov as there are federal laws protecting certain retaliatory actions, they also provide guidance on such labor board complaints when state law has simultaneous protections.
