Question

Can you sue a family for wrongful death if their father killed a relative and they are the ones that are going to get the life insurance instead of the children of the one that was killed? It was a murder suicide.

Answer

the surviving beneficiaries may sue any person who caused the injuries that precipitated the death. As he is dead, a claim may be brought against his estate, but not family members personally.

If you file suit against the estate, in what order do things get paid. ie: right now the judge can allow for $15,000 to go to the children, then executor fees and funeral expenses then taxes and other debts, so where does a lawsuit fall?

Taxes, funeral bills are paid first followed by creditor claims followed by bneneficiaries and executor fees.

well I am not satisfied with your answer, because you obviously do not know the law. My question was about if I sue the estate what order a "suit" would be paid and you did not include that in your reply. Also the information you gave was incorrect. The first thing that can be paid is $15,000 to the children if the judge orders, then funera expenses, executor fees THEN taxes and creditors. I know this because I have been to probate court and am in the process of trying to resolve everything. That is why I asked you the question to begin with. So as this site claims--I only pay if satisfied with the response and I am not.
