worked over seas 10/18/07 to 10/30/08 had two 15 day vacations. was sent home w/illness 10/30/08 will be home over 30days want to go back overseas. but dont want to stay another 330 days to count as another year an you help me understand the rules of the calander yr

I was out of country 10/18/07 was back home 03/05/08 for 15 days, came back to us 08/15/08 for 15days. went back overseas. was sent home on back injury 10/30/08 dont yet know for sure how long I will be home. I want to go back, but dont want to stay another 330 days. I have tried to understand irs pub 54. If I get back after december How long will I have to stay, in order not to have to pay full taxes

Hello and thanks you for using Just Answer. You must be physically present in a foreign country or countries 330 full days during a period of 12 consecutive months. You will be qualify for the exclusion of foreign income from 1 January 2008 to 30 October 2008 will be $71,378 ( 304 days / 365 = 0.832877 x $85,700 = $71,378)
