Question

We had a property damage loss claim over 6 months ago, the responsible parties insurance has made an offer to settle with us now but in the mean time we were working with our insurance company, we forwarded numerous estimates to them but apparently submitted one estimate that is for our own additional work and now our insurance company has voided our claim and canceled our policy due to they said committ fraud by subbmitting a bad estimate. We responded back to them explaining that we sent an incorrect estimate to them but havent heard anything as of yet. No monies were paid out on this claim. If they stick by their original decision to void the claim and cancel our policy, does this leave negitive information regarding us for other insurance companies in the future making it hard to get homeowners insurance? We are considering filing a complaint with the insurance commissioner regarding this.

I contacted my sister at Nationwide insurance (she's an agent) to get this info for you.

Her response was:

The companies are looking at loss history and/or credit history now when providing coverage. They have no way to gather information regarding this previous claim other than the amount that they have paid out for the claim.

So, if there were claims that were not acknowledged or paid, this should not be a problem.


Misdemeanor and felony convictions (if the charge is processed) do no have an impact on wether an insurance company will write your coverage or not.

Reply to Tammy Falkner's Post: We could be charged with this mistake? For the god sakes it was a difference of $1000 dollars.
The claim itself was over $35,000 dollars.

If the insurance company persues the false claim, you could be but I doubt that will happen for such a small amount.
