Already Tried:
This is he first time I have asked the question. I want to do the probate now not years later. In addition we own two time share wee                                   ks and a time interval that require the same treatment

If held as tenants in common her interest would pass to her estate and the estate would need to determine what to do with it and could quit claim deed it over to you.

This is Florida. Property is held as tennants in common andthe will states all her property goes to me, the suriving spouse. Can I do this without a long expensive case?

You will still need to probate her will and yout lawyer should be able to easily draw up the new deed for you.
