Question

My ex- boyfriend want me to sign a quit claim deed that we own together, but I would still be on a house loan. He can not qualify to refi on his own. I just want to move on with my life. How can i get my name off the house loan so one day I may buy a house on my own?

Asked my ex-boyfriend to refinance on his own, looked into a partition action to force him to sell the house, but todays housing market is so bad we wont even get what we paid for it. He is pressuring me to sign the quit claim deed.

Answer

Do not sign the quit claim and leave your name still on the loan. If you do that you lose any right to interest in the house, but still have liablity for payments as long as your name is still on the loan. You need to tell your ex-bf that he must refinance somehow (find a co-signer) or give you the quit claim and you will refinance and you will take over payments. Until your name is off the loan, do not sign over the deed to him.

I can not refinance on my own, what other options do I have? Bankrupcy?

If you qualify for bankruptcy that would work. However, if you do not, enter into a written agreement with him where he will pay the mortgage but you will only sign a quit claim when he becomes able to refinance on his own.
