Question

An elderly neighbor of ours has agreed to sell us a piece of land adjascent to ours, but wishes to retain it's use until she dies. This is a slightly different situation than a life estate. what is this agreement referred to as, and how might I go about orchestrating a legal transaction?

Visited with a surveyer in order to have a legal description of the property typed up and prepared in order for our neighbor to sign.

I have referred your question to a colleague who would have access to Utah procedure. Generally you would transfer title and retain a life estate but precise procesure I do not have access to for Utah and so have opted out of the question and referred to a colleague. should be with you shortly.

Answer: What you have suggested is indeed a life estate for your neighbor, and this would all be handled in the deed. Therefore, the deed should state that your neighbor conveys the property to you, but retains a life estate for herself. The deed should then be recorded in your county records office.
