Question

If its my first felony and its a 3rd degree felony for credit card abuse will i most likely get probation or dropped to a misdemenor or will i have to go to jail. Keep in mind Im in the military and a Sergeant as well

<p>Hello. If it is your first felony, it is highly probable that you will get some kind of probationary sentence and an order to pay restitution for the amount misused.   Whether a felony count is called or whether it is reduced to a misdemeanor is pretty much within the discretion of the prosecutor, however. If you want to ensure you get a good plea deal and try to work out a plea for the misdemeanor, you should really follow through with the lawyer and hire one to be with you in court. He or she can negotiate the best plea deal possible with the prosecutor and make sure your interests are protected.</p><p> </p><p>Good luck.</p>

So if I get a public defender because the hireable lawyer charges 3500 will i still end up with a good plea deal through public defender??

You should. In general, my experience is that public defenders get better deals because prosecutors see them day in and day out and have built better relationships with them than private counsel who is seen every so often.
