Question

Have an age discrimination issue. An EEOC violation happened but it has been past the time allowed. Advantage has been given to a younger employee through lower quota and expanded territory. I believe the company has not given me a reasonable chance for success. I have been with the co for going on 7 years. I am 62. My territory was given to someone right out of military service.

Already Tried:
Went to EEOC office and they said I had a case but the incident happened over the time limit acceptable to them.
I took information with me including emails that solicited cash to pay for a vacation for this younger hire. The manager felt he needed to give this vet a chance and help him out. He favored this employee with sales that I had worked on for two years.
In Jan 2007 my manager gave this younger fellow my territory with about two weeks notice to me.   In 2008 He gave this employee a light quota with almost two territories, while my quota was considerably higher with the territory cherry picked with accounts given to other employees.

Date was Jan 1, 2007 which is past EEOC requirements to make a claim.
