Question

I was sued for not paying a medical bill that i didn't ignore, but didn't have the money to pay. They in turn froze my bank account and took $1400 from me. That was money from a FEDERAL STUDENT LOAN. are they allowed to do that?

Answer

Yes, they can provided there is a judgment in place and you had notice. If you never got notice of the lawsuit, go to court, apply to vacate the judgment and have restraint lifted and money returned/

Ok thank you I just didn't know if they could take my federal student loan money for school. I didn't think that was fair since a Federal Student Loan is to be used for school purposes only.

but since the money was already taken out of my account, then there is nothing i can do correct. I am in the state of kansas.

Accepted Answer

You can go to court and file a motion with the aid of the pro se clerk to have the money returned as it is exempt from enforcement intended for the sole purposes of paying for education.
