Question

What are remedies for victim of misdemeanor hit and run, driver had NO license either. Property damage only. Happened in California. Driver possible illegal alien. 4 children.

Already Tried:
Usual runaround from police dept. Have copy of report in hand. Made contact with other driver, claims poverty and can only pay $100/month. Cost to fix my car is $3600, Blue Book value is $3200. Driver is without license, insurance and did hit-and-run.

Answer

Your only remedy is through your uninsured motorist policy or to sue him if he has money and collect from him. You should have notified your insurance company about this. Once you make a deal with him for payment you would be stuck by it. You should turn it over to your insurer if you have uninsured motorist, if not you would need to sue him to secure some court ordered award or settlement, but if he takes off and you cannot find him later, you will still have little luck in collecting.

Thanks for the answer. I already figured out that's what would probably happen, as I don't have uninsured motorist on my policy. Shouldn't there be some punishment for the driver? She has no driver license and she was not insured driving her 4 children around. Besides the fact she did a hit and run... That cannot possibly be legal. Please advise. Thanks!

Well, the state will bring the violator to court and could fine them up to $5,000, but you will never see any of that and they can be put in jail/have their license suspended (which is no good if they have no license to begin with). They will be punished criminally, but none of that will really help you.
