Question

I was at a nightclub last nite & a halloween prop fell from ceiling & cut my arm in 3 places not that seriously but I have several scrapes & I was bleeding pretty good. Would I have much of a case if I sued the nightclub?

Optional Information

louisville, Kentucky

Already Tried:
I talked to the nightclub manager @ he took my name & number & said that had never happened before & that someone would be in touch with me to see what needs to be done. I feel that they should be held liable in some way....what do you suggest????....it was embarrassing & ruined the rest of my night...blood dripping down my arm...didn't require medical attention. Please let me know what I should do? Thanks! Ron

Answer

hi

i think you should try to settle the matter with the club management - i dont think you will be able to get any punitive damages if you sue because it was not something that was malicious or wilfill - it was an accident, albeit possible negligence, so try to negoiate for upward $5000 and then they will counter - you could eventually settle on about $2000 without going to court.

good luck
