Question

Tuesday I told my boss I appreciated the opportunity, but was not comfortable working on his team and I would work out my departure with HR. This freaked everyone out, because I am a woman and our company has a bad rap about sexual discrimination, etc. (As they should).
I did outline my concerns and HR called me yesterday. They were nice and interested in working it out (of course they say that). I am not at all interested; I have seen too much and simply not up to changing a company. HR did tell me my benefits expire on the my last day. I wasn't prepared for that as I expected a grace period. A friend was fired from this company and received a month grace period. Anyway, is there a best way to negotiate benefits upon departure? (If that is a possibility). I am pretty nice and they do say they want to keep me, but again, they are slimey. I was smart enough and lucky enough to get a new job before I told my current employer. Thanks

Hello,

Although some companies do offer to extend benefits for a short time, they are not obligated to do so under the law. Most will not do so if a person is quitting.

Frequently, an employee who is leaving will be asked to sign a waiver promising that they will not sue the employer for anything that happened during the employment. You may, of course, choose to agree to such a waiver on the condition they offer you something like a severance or extended benefits.

Also, if the company has more than 20 employees, it is required under the federal COBRA law to offer you the opportunity to keep your health benefits for up to a year, as long as you pay the premiums.
