Question

Do I have a caseOn 03-17-2008 I accepted a position in San Antonio Texas with my present employer. I was told that "with the acknowledgment that this will be a progressive move up into the management position in 9 months or less. He understands that this will be predicated on his performance and ability to transition into the manager role." I did not receive any type of management training until 10-14-08 after I complained. Upon hire there were two employee issues which I was not allowed to handle and my authority was undermined on several occasions in front of staff. I expressed my concerns to Human Resources regarding both individuals. The first individual accredited to leave willingly and take a promotion to another department The second individual was told she could not leave due to her behavior and disciplinary action. The individual is a known friend of the HR Director and was moved to another department as she was liable to "lawyer" up and had filed an previous EEOC compliant. This individual during her employment with me went to the HR director several times. When her evaluation came up "I was told to change it and that it was to harsh. Do you really want to go to court?" by the HR Director.This individual was granted an interview with another department without my prior consent and did not get the job. She went to the HR Director again and was moved to her former department with her pay and before her 6 months in her current position. She started 04-01-08 and was moved to her old department 09-26-08. I was told of the move on 09-11-08 prior to that she had met with her on 09-02-08 and requested she be moved by 09/16/08 which I denied due to short time frame and replacement factors. Prior to her leaving the individual continued with behavioral issues and created a hostile work environment between me and my other employees. As a result I had issues with other employees and expressed my concerns of lack of respect. On 10-08-08 an EEOC complaint was filed by another individual for discrimination and hostile work environment she was told she had until 10-28-08 to mediate. This individual is a former co worker and friend and I was listed on the complaint as a witness. On 10-20-08 I was told I had a new manager and would no longer answer to the C00. I inquired about my possibly managerial status and was told " I had several issues to work on" and hadn't been in the position long enough to tell if I would make a good manager or not.I expressed concern at what was promised to me and was told "She is no longer here" meaning my previous manager who "resigned" on 08-18-08. On 1 -28-08 I received my performance evaluation and received a 2.88/5.00 which is the lowest score I have received while employed with the company.In fact it was lower than my 90 day eval of 3.75. I was told I need to work on my communication and decision making. During the eval I was told by the COO this is not the one I sent to HR I will get you a corrected copy. Since the EEOc complaint was filed on 10-08-08, I have received negative e-mails and have not been spoken to Human Resources. There has been an air of hostility created by the compliant and I am fearful I will lose my job as a result.
