Question

a disgruntled ex-employee went to the labor board and told them I was paying overtime in cash instead of in the check. i was told that this was okay as long as it was reported in their 1099. I thought a 1099 was for an independent contractor. These are people that are not independent contractors but employees that receive a W-2 at the end of the year. Now the board is coming on Monday to review my payroll info. What information should I have available for them and what are my liabilities? I didn't do the actual payroll, my bookeeper did? What can I expect from this visit?

You are not required to pay by check or issue 1099 to employees. Be sure to have a complete records of employee hours, pay issued, overtime paid, tax witholding. If you are not sure you have complied, ask to adjourn the review and have an accountant review your paperwork. The visit will seek to review your books, so its important that they are accurate.
