Question: “i was written a check for 1,500.00 dollars and the solicitor has filed a warrant on this person. if she is arrested will she still have to pay for the check. will she still have to pay me the $1,500.00 ?”
Answer: Yes, the crook owes you for the amount of the check. If convicted of writing a bad check, then the judge will probably order the crook to pay you restitution (i.e. the amount of the check). However, even if the judge doesn’t, or you don’t want to wait for the criminal trial, you can sue the crook in small claims court. Winning a case for a bad check is actually quite easy. All you need to prove is that you were given the check and that it bounced. Unless the person has a viable defense (such as check forgery or that you didn’t fulfill your obligations that called for you to be paid), then you’ll win your case.
