Question

I was terminated from my position on October 21,2008 and I was given a severance agreement and release of all claims form. Basically the company will pay me three months severance pay. It stipulates that if I sign the severance agreement I also release the Releasees for disability discrimination, any violation of the Civil Rights Act of 1964, ERISA, Age Discrimination in Employment Act of 1967, the Older Workers Benefit Protection Act, the Family and Medical Leave Act and Nevada Labor Relations Law. The company that I worked for Minerva Office are the Trust administrators for three large Trusts. The three Trusts combined their net worth is over two billion dollars. My title was Senior Tax Analyst and the office had twelve employees. The Trust Administrator lives in California and came to our office once a month. I am the oldest in the office and the only male and I would like to know should I sign this Severance agreement.

I was terminated because of performance issues. I worked for the company for two and a half years and my performance reviews were average. In other words I was just a three on a scale of 1 to 5. But the company just hired a female to be my Supervisor and within a few months I was written up and put on probation on September 8th. I was to be re-evaluated on October 8th regarding my performance. On October 8th I was verbally told that my work performance had improved but they extended my probation not telling me when the probation would be over. My Supervisor also said on the 10/08 meeting that my probation was extended because my workload is easier. She is correct my workload gets really busy from January-October and I always said this is a tremendous amount of pressure on me since I was the only one doing any tax work. The new Supervisor knew nothing about taxes and refused to learn anything. I am 56 years old and was the only male in the office.

Nevada is an employment at will state. This means that an employer can fire whoever they want, when they want, for whatever reason they want, with limited exceptions, as long as it is not for a discriminatory purpose.

I dont see a claim here unless want to pursue a claim for age discrimination with the EEOC. If so, the links below will help. Please accept my answer.
